Terms of Service/ Terms and Conditions

By using Life Evergreen’s Product promotion & verification services especially its Mobile Product Authentication service, you concur to be bound by the following Terms & Conditions or the “Terms of Service”. If in any case you do not agree to these terms of service, please cease your use of Services instantly and uninstall any application that you have installed as part of the services.

We may amend these Terms of Service at any time without any previous notice by keeping informed this page and any such changes shall be effectual upon posting to this page. Please go through this page every so often to know about the updates done by us. Your continued uses of the Services even after revisions of these Terms of Service encompass your receipt of such changes.    

The services may aid users by confirming Identification codes that are created at the request of clients that are used by the Life evergreen clients on specific products or products packaging. Identification codes consist of 13 digit number. Using the SMS text users can verify the authenticity of products. You admit that to verify Identification Codes the Services depend on accurate diffusion of Identification Codes and other information.  

Some of the services will offer users with additional information or potentially reward users for certain actions or in forces.  

The services are offered on the basis of “as is” and “as available” concept. Life Evergreen does not make and rejects all articulate and indirect warranties and representation with respect to services.  In particular, we specifically deny any warranty:

       a.  the users will have at any time uninterrupted access to the services

      b. The services will at all time be error free.

All the saleable code warranties are expressly renounced by the parties. Thus, this disclaimer of warranty represents a vital part of this Agreement.    

 

Life evergreen shall not be legally responsible for any damage or losses arising from:

        i. Malfunction of user to accurately read the identification code or other information or a response to information submitted to Product Authentication portal. 

         ii. Failure of any user’s communication service or communication device.

        iii. User error in accurately transmitting information to us. 

       iv. Any kind of error or imprecise verification caused due to any kind of mess about, removal or illegal modification of a package, label or item containing the information code or other information by any person or means.

        v. Substantial damage to information code or other product information that renders such information illegal.

       vi. Fault on the part of the users to completely follow the instructions with view to the use of services.

      vii. Any extent of damage that may arise due to misconduct or negligence of the user.

Under no conditions shall Life Evergreen, its partners, directors or affiliates be answerable for any incidental, indirect or consequential damages or for lost profits.  These Terms of Service are governed by the laws of Nigerian Government.  

If any stipulation or segment of these Terms of Service is held against the law, unacceptable or unenforceable, in whole or in part, it shall be customized to correct any deficits or reinstate with a condition which is as close as is legally permissible to the provision found invalid or unenforceable and shall not influence the legality, soundness or enforceability of any other sections of these Terms of Service.
